Terms of Service

1. Acceptance of Terms

By creating an account or using CellarFox (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by CellarFox (“we”, “us”, or “our”).

2. Eligibility

You must be at least 18 years old and legally permitted to purchase or consume alcohol in your jurisdiction to use CellarFox. By using the Service, you represent that you meet these requirements.

3. Your Account

• You are responsible for maintaining the security of your account credentials
• You must provide accurate information when registering
• You may not share your account with others or create accounts on behalf of third parties without authorisation
• Notify us immediately at support@cellarfox.com if you suspect unauthorised access to your account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble the Service
• Introduce malware, viruses, or other harmful code
• Scrape or crawl the Service without our written permission
• Resell or sublicense access to the Service

5. Your Content

You retain ownership of the data you enter into CellarFox (your wine collection, tasting notes, etc.). By using the Service, you grant us a limited licence to store, process, and display that data solely to provide the Service to you. We do not claim ownership of your content and will not use it for any purpose other than operating and improving the Service.

6. Free and Paid Plans

CellarFox offers a free tier with a limited number of bottles. Paid plans unlock additional capacity and features. Pricing is displayed in the application and may change with reasonable notice. Fees are non-refundable except where required by applicable law.

7. Availability and Changes

We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features of the Service at any time. Where reasonably practicable, we will provide advance notice of significant changes.

8. Recommendations Disclaimer

Fox Picks, serving guides, and drinking-window estimates are informational suggestions based on general wine knowledge and the data you provide. They are not professional sommelier advice. Actual drinking windows vary by storage conditions, individual taste, and bottle variation. Drink responsibly.

9. Intellectual Property

The CellarFox name, logo, and all original content, software, and design elements are owned by us and protected by copyright and other intellectual property laws. Nothing in these Terms grants you a licence to use our trademarks or branding.

10. Limitation of Liability

To the maximum extent permitted by law, CellarFox and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service — including loss of data or collection records. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or €50 if you are on a free plan.

11. Termination

You may delete your account at any time from the account settings screen. We may suspend or terminate your account if you breach these Terms, with or without notice depending on the severity. Upon termination, your data will be deleted per our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of Denmark, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice. Continued use of the Service after the effective date of the updated Terms constitutes your acceptance.
